This petition is filed on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 (‘1996 Act’) seeking extension of the mandate of the learned Arbitrator.

Disputes having arisen between the parties in relation to Purchase Order placed upon the Petitioner by the Respondent on 05.01.2019, Sole Arbitrator was appointed by Delhi International Arbitration Centre (‘DIAC’) to adjudicate the disputes. Period of one year from the date of completion of pleadings expired on 29.05.2024. With the consent of the parties, mandate of the Arbitrator was extended by six months from the said date and before expiry of the extended period, Petitioner approached this Court seeking extension and vide order dated 25.10.2024 mandate of the Arbitrator was extended by a period of six months from 30.11.2024 till 30.05.2025. It is stated in the petition that the arbitral proceedings are at the stage of final arguments, for which the Arbitrator has fixed the dates of 04.08.2025 and

Ms. Leena Tuteja, learned counsel accepts notice on behalf of the Respondent and on instructions, submits that the Respondent has no objection to the extension of mandate of the learned Arbitrator.

Accordingly, with the consent of the parties, mandate of the learned Arbitrator is extended by a period of 06 months from 31.05.2025.

Petition is allowed and disposed of in the aforesaid terms.
