By way of present writ petition, the petitioners are seeking directions to the respondent to provide security to them.

Issue notice. The learned ASC for the State accepts notice.

Brief facts of the case are that the petitioners are family members, and a civil suit for possession was pending between them, and on 15/16.11.2022, the possession of the suit property was handed over to one Mohd. Anwar, despite resistance and opposition by the petitioners. Thereafter, the police officials had used force to help handing over of possession. It is stated that the police officials had threatened and had wrongfully confined the petitioners to facilitate handing over of possession. On 17.11.2022, the petitioners had submitted a written complaint to higher authorities regarding the aforesaid incident. Thereafter, scuffle had taken place between the

parties and pursuant to this, FIR bearing No.324/2023 under Section 384/385/506 of the Indian Penal Code, 1860 (hereafter „ IPC ‟) was registered. Another FIR bearing No. 595/2023 was also registered on 02.08.2023 regarding the incident dated 15/16.11.2022. On 30.04.2023, one of the grandsons of the petitioner was stabbed on his neck, which had led to the registration of FIR bearing No.331/2023. On 22.12.2024, one son of the petitioner was also stabbed, and another FIR bearing No. 811/2024 was registered against the accused persons. All these FIRs have been registered at Police Station Seema Puri, Delhi.

The learned counsel for the petitioners argues that the petitioners had submitted written complaint to SHO at Police Station Seema Puri, Delhi, requesting for providing protection and security as they are under repeated attacks at the hand of the accused persons. Despite making several efforts, no satisfactory answer or any investigation was carried out in the said case, neither did the competent authorities provide protection to the petitioners. Therefore, it is prayed that protection be granted to the petitioners from the accused persons in the abovementioned FIRs.

This Court has heard the submissions on behalf of petitioners as well as the State.

Considering the overall facts and circumstances of the case, and the fact that petitioners have prayed for protection of their life as they are apprehending threats from the accused persons, the petitioners are directed to provide their mobile number to the concerned Investigating Officer, and the SHO. Similarly, the mobile numbers of concerned IO, SHO, and beat constable be also shared with the petitioners.

including SHO are directed to provide adequate protection to the petitioners from the above-mentioned persons, in case such circumstances arise and they approach them, immediately upon being contacted.

In case the petitioner so desires, he can approach the Witness Protection Committee of the concerned District Court, as he states that he has been threatened by the accused persons and he has threat to his file. The concerned District and Sessions Judge is requested to ensure that the application moved by the petitioner, will be decided expeditiously, preferably within 10 days of the application being moved.

The learned counsel appearing for petitioners states that he is satisfied with the aforesaid arrangement.

Accordingly, the present writ petition stands disposed of in above terms.
