1. Petition under Section 482 of Cr.P.C. has been filed on behalf of the Petitioner for quashing of FIR No.0393/2017 under Sections 354/354A/ 354B/376/511/341/342/506 IPC, registered at PS: Farsh Bazar, Delhi and all consequential proceedings emanating therefrom, in terms of Settlement Deed dated 17.03.2020.

Brief facts of the case are that due to dispute between the Petitioner (father-in-law of Respondent No.2) and Respondent No.2 (daughter-in-law of the Petitioner), Respondent No.2 filed a Complaint on 19.08.2017, wherein she had made allegations of sexual assault by the Petitioner, who was her father-in-law. On this Complaint, FIR No.0393/2017 under Sections 354/354A/354B/376/511/341/342/506 IPC was registered at PS: Farsh Bazar, Delhi.

5. It is submitted that present FIR was a consequence of the matrimonial disputes between the Petitioner/father-in-law and Respondent No.2/ daughter-in-law. It is stated that with the intervention of family members, relatives and well wishers, the Petitioner and Respondent No. 2 have amicably settled all the disputes and differences between them vide Settlement Deed dated 17.03.2020.

6. The parties are present in the Court and have been identified by the IO. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Settlement Deed dated 17.03.2020 with their wish and will.

7. It is also stated that, the marriage between the son of Petitioner No.1 and Respondent No.2, has already been dissolved by mutual consent, as per the Hindu law.

8. Learned Counsel for Petitioners submits that the parties have no grievance against each other. Since Respondent No. 2 has already made a statement before the Court that she does not want to pursue the proceedings in FIR, the present Petition be allowed and FIR No.0393/2017 be quashed.

9. In view of Settlement Deed dated 17.03.2020, present Petition has been filed.

10. Respondent No.2 is present and submits that she has no grievance against the Petitioner and also no objection to the quashing of FIR. She further submits that she has received full amount of settlement, i.e. Rs,10,00,000/- and now has re-married and has a child.

11. In view of the fact that the FIR in question was premised upon a matrimonial dispute between Petitioner No.1/father-in-law and Respondent No.2/daughter-in-law, which has been amicably resolved in terms of

Settlement Deed dated 17.03.2020. Considering the fact that parties have given no objection to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings arising out of the FIR.

12. Consequently, FIR No.0393/2017 under Sections 354/354A/354B/ 376/511/341/342/506 IPC, registered at PS: Farsh Bazar, Delhi and all consequential proceedings emanating therefrom are quashed. 13. The Petition along with pending Application is disposed of.
