Petition under Article 226 and 227 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973, has been filed on behalf of the Petitioner, to set-aside the Order dated 17.05.2023 of the Appellate Tribunal whereby the Petitioner has been permitted release of vehicle Maruti Suzuki Desire bearing No.OD-02-AR-0468, on furnishing of a bond in the sum of Rs.6,50,000/-.

Valuation Report has been filed by the learned CGSC in the Court today. Let the same be taken on record.

Learned counsel for the Petitioner submits that it is an old Car and the value of the vehicle is much less and therefore, the Superdari amount may be reduced.

wherein it is submitted that the registration number of the Car is of 20.12.2017 and the Car is now seven years and three months old. The purchase cost was Rs.7,51,592/- and the present valuation approximately is Rs.1,50,000/-.

State has no objection if the Superdari amount is accordingly modified.

Learned counsel for the Petitioner submits that he has not been able to get the car release for want of deposit of the bond amount.

Considering the submissions made, the vehicle Maruti Suzuki Desire bearing No.OD-02-AR-0468, be released on deposit of an FDR in the sum of Rs.2,00,000/-. The impugned Order dated 17.05.2023 is modified to the said extent. In case, the Petitioner is still aggrieved, he is at liberty to move before the Tribunal, to seek further modification for release of the said vehicle on Superdari.

The Petition is disposed of accordingly.
