A Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘B.N.S.S.’) read with Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as ‘Cr.P.C.’) has been filed on behalf of the Petitioners, for quashing of FIR No.199/2019 under Section 354(D), 506, 109, 509 and 34 of the Indian Penal Code, 1860 (hereinafter referred to as ‘IPC’) registered at Police Station Harsh Vihar and all the proceedings emanating therefrom.

The parties are present in person and their statements have already been recorded by the learned Joint Registrar in terms of the Settlement Deed dated 11.11.2024, whereby they have settled their disputes.

submits that she is happily residing in her matrimonial home and has no objection to the quashing of FIR.

The perusal of the FIR No.199/2019 shows that Petitioner No.1 is the husband of the Complainant and there was some matrimonial dispute on account of which the Complainant was living separately from her husband. During that time she had alleged that the Petitioner No.1 her husband used to talk with her and used to say inappropriate things to her. At times he used to hand over his phone to his friend Mukesh who also behaved similarly. The Petitioner No.2 who was her devar also threatened him and gave abuses.

On the statement of the Complainant FIR No.199/2019 under Section 354(D), 506, 109, 509 and 34 IPC was registered at Police Station Harsh Vihar.

The present Petition has been signed by all the parties and is supported by their respective affidavits. The parties have reaffirmed the terms of the settlement arrived at vide Compromise Deed dated 11.11.2024 and they also submit that the said Compromise Deed has been arrived at between the parties without any pressure and coercion.

The respondent No. 2/wife submits that she has been livingly in her matrimonial home peacefully after reconciling all the issues with the Petitioners. Today, the complainant/respondent No. 2/wife, who is present in Court, states that she has no objection if the FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and also the fact that the present matter is a family matter, I am of the opinion that no useful purpose will be served in continuing with the proceedings, rather the

same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing No.199/2019 registered at Police Station Harsh Vihar, for offences punishable under Sections 354(D), 506, 109, 509 and 34 of the Indian Penal Code, 1860 and all consequential proceedings emanating therefrom are quashed.

The petition stands disposed of along with pending Application(s).
