Magistrate-02, Saket Court, as well as, summoning order dated 21.07.2020. 4. Learned counsel appearing on behalf of the petitioners submits that during the pendency of the present proceedings, the company has already arrived at a settlement with the respondent /complainant and in terms of the said settlement, the complainant has handed over four apartments in a finished condition on 29.06.2024 in terms of the order dated 05.07.2023 passed by a Co-ordinate Bench of this Court in Company Petition No.668/2014. It is further submitted that the aforesaid complaint case with respect to two coaccused persons in the said complaint, namely, Sushil Aggarwal and Vijay Kumar Sood has already been quashed vide order dated 11.12.2024 in CRL.M.C. 195/2021 and CRL.M.C. 872/2021 respectively.

Respondent no. 2 is present before the Court and petitioners are present through video conferencing and have been duly identified by their respective counsels.

Respondent no. 2, who is present in person and Standing counsel for R- 3/official liquidator submits that they have no objection if the said complaint alongwith the summoning order is quashed against the present petitioners.

In view of the aforesaid circumstances, and the fact that the parties have put a quietus to the dispute, no useful purpose will be served in continuing with the present Complaint Case No. 5051/2019, titled Ikramul Haq v. MVL Ltd. & Ors., pending in the Court of learned Metropolitan Magistrate-02, Saket Court, as well as, summoning order dated 21.07.2020.

In the interest of justice, the petition is allowed, the Complaint Case No. 5051/2019, titled Ikramul Haq v. MVL Ltd. & Ors., pending in the Court of learned Metropolitan Magistrate-02, Saket Court, as well as, summoning order dated 21.07.2020 are hereby quashed qua the petitioners.
