The present petition under Section 528 of the BNSS seeks quashing of FIR No. 437/2025, under Sections 115(2)/126(2)/3(5) of the BNS, registered at P.S. Begum Pur.

Learned counsel for the petitioners submits that the present FIR was registered on account of a minor dispute which had arisen in respect of some property ownership in which respondent no.2 who is husband of petitioner no. 1 and father of petitioner no. 2, had sustained injuries. It is further submitted that the parties have since compromised their disputes vide MoU dated

25.06.2025, and in pursuance of the same, the present petition has been filed seeking the quashing of the present FIR.

Copy of the MoU/Settlement Deed dated 25.06.2025 has been placed on record and annexed with the present petition as Annexure- P-5 wherein, it has been recorded that the matter between the parties has been settled and they will cooperate with each other in quashing of the present FIR.

Petitioners no. 1 and 2 and respondent no. 2 are present before the Court and have been duly identified by their respective counsels, as well as the Investigating Officer, SI Jagdeep Sandhu, PS Begumpur.

The Complainant/respondent No.2 states that the matter has been settled with the petitioners and he has no objection if the FIR is quashed against the petitioner. He further states that all the terms of the settlement have been complied with.

Learned APP for the State submits that investigation in the present FIR is pending and chargesheet is yet to be filed.

In Gian Singh v. State of Punjab, (2012) 10 SCC 303, the Hon’ble Supreme Court has recognized the need of amicable resolution of disputes by observing as under:-

“61. ... In other words, the High Court must consider whether it would be unfair or contrary to the interest of justice to continue with the criminal proceedings or continuation of criminal proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceeding.”

In view of the aforesaid circumstances, and that fact that the parties have put a quietus to the dispute, no useful purpose will be served in

In the interest of justice, the petition is allowed, and the FIR No. 437/2025, under Sections 115(2)/126(2)/3(5) of the BNS, registered at P.S. Begum Pur, is hereby quashed.
