Marriage of petitioner no. 1 and respondent no. 2 solemnized 04.12.2017; the wife's FIR implicated husband, father-in-law, brother-in-law and sister-in-law; her two children from a prior marriage had been adopted by petitioner no. 1 by adoption deed. Parties signed a Compromise/MoU dated 01.02.2025 and the couple has resided together for the last 4 years. The present petition under Section 528 of the BNSS seeks quashing of FIR No. 621/2018, under Sections 498A/406/34 IPC, registered at PS Begum Pur, Delhi and all other consequential proceedings emanating therefrom, including the chargesheet filed and pending before the Court of Ms. Preeti Rajoria, learned JMFC, Rohini Courts, Delhi.

The marriage between the petitioner no.1/husband and the respondent no.2/wife was solemnized on 04.12.2017 as per Hindu Rites and Customs and no child was born out of the said wedlock. It is pertinent to note that from the previous marriage of respondent no. 2, she had two children who were adopted by way of an adoption deed by petitioner no. 1.

Due to matrimonial differences between petitioner no. 1 and respondent no. 2, respondent no.2/complainant lodged an FIR against petitioner no. 1 (husband), petitioner no. 2 (father-in-law), petitioner no. 3 (brother-in-law) and petitioner no. 4 (sister-in-law).

Learned counsel for the petitioners submits that parties have arrived at Compromise/MoU dated 01.02.2025, and as per the said MoU, petitioner no.1 and respondent no. 2 have agreed to amicably settle their disputes and quash the present FIR along with the chargesheet pending before the Court of competent jurisdiction. It is further submitted that petitioner no.1/husband and respondent no. 2/wife have been residing together since last 4 years.

Petitioner Nos. 1,2 & 4 and complainant/respondent no. 2 are present in person before the Court and have been duly identified by their respective counsel, as well as the Investigating Officer, SI Jagdeep Sandhu, PS Begum Pur. Petitioner no. 3 is stated to be out of town and on oral request, his personal appearance is exempted.

Complainant/respondent No.2 states that the matter has been settled with the petitioners and she has no objection if the FIR is quashed against the petitioners. She further states that all the terms of the settlement have been complied with and she is residing with petitioner no. 1/husband for last 4 years.

In view of the settlement between the parties, learned APP for the State also has no objection if the present FIR is quashed.

In Gian Singh v. State of Punjab (2012) 10 SCC 303, Hon’ble Supreme Court has recognized the need of amicable resolution of disputes by observing as under:-

In other words, the High Court must consider whether it would be unfair or contrary to the interest of justice to continue with the criminal proceedings or continuation of criminal proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceedings.”

In view of the aforesaid circumstances, and the fact that the parties have put a quietus to the dispute, no useful purpose will be served in continuing with the present FIR No. 621/2018, under Sections 498A/406/34 IPC, registered at PS Begum Pur, Delhi and all other consequential proceedings emanating therefrom, including the chargesheet filed and pending before the Court of Ms. Preeti Rajoria, learned JMFC, Rohini Courts, Delhi.

In the interest of justice, the petition is allowed, and the FIR No. 621/2018, under Sections 498A/406/34 IPC, registered at PS Begum Pur, Delhi and all other consequential proceedings emanating therefrom, including the chargesheet filed and pending before the Court of Ms. Preeti Rajoria, learned JMFC, Rohini Courts, Delhi, is hereby quashed.
