Writ petition under Article 226 of Constitution of India read with Section 528 of BNSS has been filed on behalf of the Petitioner for quashing of order dated 24.03.2025 and to release the Petitioner on first spell of Furlough for a period of three weeks.

As per the petition, the Petitioner had applied for first spell of Furlough of two weeks in February, 2025, which was rejected vide order dated 24.03.2025.

Learned Counsel on behalf of the State submits that since it is the first time after conviction that Petitioner has sought to avail his furlough, his residential address is required to be verified.

The Furlough application of the Petitioner was rejected on 24.03.2025

by observing that the Police Report and the Report of the Probationer Officer were still awaited.

While from the Order itself, it is evident that the Police Report and the Probation Report had already been sought by the Jail Superintendent in FebMarch, 2025, when the Application was filed by the Petitioner and it would have definitely be received by the authorities in the previous two months.

No reasons found to not grant the first spell of Furlough to the Petitioner.

Considering the totality of the circumstances, the Petitioner be released on first spell of furlough for a period of three weeks, on the following terms and conditions:

i. The Petitioner shall furnish a personal bond in the sum of Rs.10,000/- with one surety of the like amount, to the satisfaction of the Jail Superintendent.

ii. The Petitioner shall report to the SHO of the local area once a week on every Sunday between 10:00 AM to 11:00 AM during the period of Furlough.

iii. The Petitioner shall furnish a telephone/mobile number to the Jail Superintendent as well as SHO of local police station, on which he can he contacted, if required. The said telephone number shall be kept active and operational at all the times by the Petitioner.

iv. The Petitioner shall ordinarily reside at the address mentioned in the petition.

v. Immediately upon the expiry of period of Furlough, the Petitioner shall surrender before the Jail Superintendent.

vi. The period of Furlough shall be counted from the day when the Petitioner is released from jail.
