The present petition, filed under Article 226 of the Constitution of India, 1950, seeks the expeditious handling of Criminal Case No. 1520/2021. The said proceedings were initiated by 27 Complainants, including the present Petitioner, against the builders in relation to Colors Housing Society, Plot no. 49B, Pocket 7, Section 29B, Dwarka, New Delhi110075.¹ The Petitioners are homebuyers who have invested in the said Project.

By an order dated 11^th October, 2022, the Chief Metropolitan Magistrate, Dwarka, directed that the aforesaid complaint case be clubbed with proceedings arising out of FIR No. 74/2017 registered at P.S.

Economic Offences Wing, as both matters pertain to allegations made by homebuyers against the same builder in relation to the same housing project.

The Investigating Officer present in Court, informs that the first chargesheet was filed in January, 2022. Thereafter, as more homebuyers approached the authorities with similar grievances, supplementary chargesheets were filed in January, 2023 and again on 24^th March, 2025. The Investigating Officer also states that approximately 82 homebuyers have now come forward, and further supplementary chargesheets may be required to comprehensively address all complaints arising from the project in case further homebuyers approach them.

Having regard to the sheer volume of complainants and the complexity of allegations involving multiple supplementary chargesheets, this Court is of the view that issuing a direction for time-bound disposal would not be practical at this stage. Nonetheless, bearing in mind the prolonged pendency and the nature of grievances raised by the homebuyers, many of whom are awaiting redressal after having invested substantial sums, the Trial Court is expected to take all necessary steps to ensure that the proceedings are conducted with due expedition and without avoidable delay. 5. With the above directions, the present petition, along with pending application(s), is disposed of.
