The present petition under Sections 11 and 12 of the Contempt of Courts Act, 1971 seeks the following prayers:-

“a) An order holding Dugar Overseas Pvt. Ltd. I.e. Contemnor No. 1 company and its directors Mr. Nagraj Dugar i.e. Contemnor No.2, Mr. Manoj Dugar i.e. Contemnor No.3 and Mr. Sanjay Jain i.e. Contemnor No. 4 guilty of disobeying and not complying with the Final Order dated 27.10.2021 passed by this Hon'ble Court in CS (COMM) NO. 351 of 2021 titled Red Bull AG v. Dugar Overseas Pvt. Ltd.;

the Final Order in the decree passed by the Hon 'hIe Court; c) Appropriate orders against the Contemnors, jointly or severally, directing the attachment of the Contemnors' assets and property mentioned in the memo of parties;

d) An order directing the directors of the Contemnor No.1, Mr. Nagraj Dugar, Mr. Manoj Dugar and Mr. Sanjay Jain to be detained in custody as per Section 12 of the Contempt of Courts At, 1971;

e) An order imposing a fine on the Contemnors, jointly or severally, for such amount as this Hon'ble Court may deem fit and proper; and

f) Such other further orders as this Hon'ble Court may deem fit and proper in the facts and present case.”

Learned counsel for the parties submit that the Settlement Agreement dated 11.09.2025 has been arrived at between the parties and a copy of the same has been supplied, which has been signed by the respondent.

Learned counsel for the petitioner, on instructions, submits that the latter has agreed to sign on the agreement which will be executed finally between the parties within a week. Copy of the agreement signed by respondent is taken on record.

Relevant portions of the agreement with respect to present petition are as under:-

“2.1 (b) It shall jointly with Duggar Overseas, make a submission in the Contempt Petition pending before the Hon’ble High Court of Delhi that the Parties have settled their disputes and seek disposal of the Contempt Petition.” 2.2 (g) The stock of 3051 cans which had been seized by the Ld. Local Commissioner on 09.08.2022 will be destroyed by Duggar Overseas.”

In view of the above, learned counsel for the petitioner does not press this petition.

The respondent shall comply with clause 2.2 g in the aforesaid agreement.

The petition is disposed of as not pressed.

¶30

Pending application, if any, also stands disposed of.
