The present petition under Sections 2(B)/12 of the Contempt of Courts Act read with Article 215 of the Constitution of India seeks following

prayers:-

“I. Pass an order directing the Contemnor to comply with in letter and spirit the directions contained in the order dated 31.07.2025 passed in W. P. (Civil) No. 11288 of 2025;

II. Initiate Contempt proceedings against the Contemnor for wilful disobedience of order dated 31.07.2025 passed in W. P. (Civil) No. 11288 of 2025 by the Hon'ble Delhi High Court;

III. Pass an order imposing exemplary costs on the Contemnor for having wilfully and deliberately not complying with the directions of this Hon'ble Court.

IV. Pass any such directions or order that this Hon'ble Court deems fit and proper in the facts and circumstances of the above mentioned case”

respondent has violated the directions contained in paragraphs 5 and 7 of the order dated 31.07.2025 passed by learned Division Bench in Writ Petition (Civil) No. 11288/2025. Paragraphs 5 and 7 of the said order reads as under:-

“5. As such, we dispose of this petition by directing the respondent to decide the representation dated 18th July 2025 expeditiously, and in any case, within 12 weeks from today.

Needless to clarify, the existing COV held by petitioner is valid; it is open for them to carry out vending in accordance with the terms therein”

Learned counsel appearing on behalf of the respondent, who appears on advance notice, submits that period of 12 weeks as prescribed in paragraph 5 of the aforesaid order is still not complete and so far as the violation of paragraph 7 is concerned, it is pointed out that a drive was conducted by the MCD with respect to encroachment and violation of the terms and conditions of COV.

In view of the above, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition, with liberty to file a fresh petition if the representation dated 18.07.2025 is not decided within 12 weeks from today.
