Dalip Singh@ Langda Vs the State Govt. of NCT of Delhi

The instant application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [earlier under Section 439 of the Code of Criminal Procedure, 1873 (hereinafter “Cr.P.C”)] has been filed on behalf of the applicant/petitioner seeking extension of interim bail for a further period of three months on medical grounds.

Learned counsel appearing on behalf of the applicant submitted that the petitioner is suffering from HIV infection and his medical condition is deteriorating day-by-day.

It is submitted that the applicant was granted interim bail by the Coordinate Bench of this Court vide order dated 4^th September, 2024 and the same was further extended by this Court vide order dated 23^rd October, 2024. It is submitted that the instant petition is filed seeking a further extension of interim bail due to the deteriorating medical condition of the applicant, who is undergoing treatment in a private hospital.

Therefore, in view of the aforesaid facts and circumstances, it is prayed that the applicant may be granted an extension of interim bail for three months on humanitarian and medical grounds.

Per contra, learned APP appearing for the State vehemently opposed the instant application, however, did not contradict the fact that the petitioner is suffering from HIV infection and his deteriorating medical condition.

Heard the learned counsel for the parties and perused the contents of the instant application.

Upon perusal of the contents of the application as well as the submissions advanced on behalf of the parties, it is an admitted fact that the applicant is suffering from HIV infection and that his medical condition is gradually deteriorating.

In light of the aforesaid admitted fact alongwith the fact that the applicant’s interim bail expires on 23^rd February, 2025, this Court is of the view that the interim bail of the applicant be extended till 30^th May, 2025.

In view of the above facts and circumstances, the interim bail granted to the applicant is extended till 30^th May, 2025 on the same terms and conditions as imposed vide order dated 4^th September, 2024 in BAIL APPLN. 2261/2024.

It is made clear that after expiry of interim bail period, the applicant shall surrender before the Jail Superintendent/Court concerned on or before 30^th May, 2025.
