Heard the learned counsel for the parties.

Learned counsel representing the tendering authority- the Medical Superintendent, VMMC & Safdarjung Hospital has handed over to the Bench, written instructions as contained in the letter dated 13.08.2025 communicated by the Medical Superintendent of the said hospital which states that the tendering authority shall place the order for 24000 pieces in Bid No. GEM/2024/B/5234419 dated 08.08.2024 for which the petitioner i.e. Durga Surgical Corporation is already L-1. Further instructions are that the

2. We shall procure 1/4 the of the Bid quantity of the following Bids from the petitioner upon his undertaking that he shall supply the product at the Last Purchase Price subject to his sample found acceptable as per specification of the bid item.
