The present petition has been filed by petitioner seeking following reliefs:

“a. pass a writ, order or direction in the nature of certiorari or any other appropriate writ, thereby, quashing the order dated 24.6.2024 passed by the Vice Chairman, Delhi Development Authority;

b. pass a writ, order or direction in the nature of certiorari or any other appropriate writ, thereby quashing and setting aside clause 1(iii), Part-B, of the Delhi Delhi Slum & J J Rehabilitation and Relocation Policy, 2015;

c. pass an order in the nature of the writ of mandamus or any other writ of similar nature directing the Respondent to allot a dwelling unit to the petitioner”

Mr. Rishi Nandy, the learned counsel for the petitioner submits that despite Appellate Authority of DDA has decided in favour of petitioner, the claim of petitioner has been rejected by the Competent Authority.

He submits that case of petitioner is identical to the writ petitioners who were considered under category ‘B’ in the judgment dated 06.06.2025 passed in W.P.(C) 3350/2023 and other connected petitions. He submits

that the benefit of Para 86 of the said judgment may also be extended to petitioner, which reads thus:

“86. Accordingly, W.P.(C) 9870/2023 and those connected matters forming Category: Part-B are hereby allowed. A writ of mandamus is issued, thereby directing the Competent Authority to review, reconsider or recall their impugned decisions rejecting the claims of the present set of petitioners within six weeks, as per the 2015 Policy, and to proceed with their relocation and rehabilitation in accordance with law. The writ petitions are disposed of accordingly.”

Ms. Kritika Gupta, learned counsel appearing on behalf of respondent/DDA submits that petitioner has approached this Court belatedly. However, she does not dispute that the petitioner is similarly situated as writ petitioners whose cases were dealt with under category ‘B’ in judgment dated 06.06.2025 (supra).

In view of the above, the impugned order dated 24.04.2024 (Annexure P-1) is quashed and set aside.

Consequently, it is directed that benefit of the aforesaid judgment dated 06.06.2025 (supra) shall also enure to the petitioner as well. Accordingly, the case of petitioner be re-considered within a period of eight weeks in terms of above quoted Para 86 of the said judgment.

The petition stands disposed of.
