The present petition has been filed under Article 226 of the Constitution of India seeking following relief:

a) issue a writ of mandamus or any other suitable writ, order or direction to the Respondents to inspect the new premises and process & decide the petitioner's application dated 26.02.2024 for shifting of their premises and also for change of name of institution for running B.A.B.Ed. and D.El.Ed. Courses in a time bound manner; and/or

Mr. Amitesh Kumar, the learned counsel for the petitioner submits that the petitioners had submitted an application dated 26.02.2024 seeking permission for shifting of their premises of B.A.B.Ed (APP201660217) and D.El.Ed (APP201660217) courses and also change of name. He submits that requisite processing fee of Rs.1.77 lacs each was paid by the petitioners for both the requests vide two separate demand drafts.

the Western Regional Committee/respondent no.2 is not considering/processing the petitioners’ application.

Mr. Akhilesh K. Srivastava, the learned Standing Counsel for the respondents submits that the applications of the petitioners have been received and the same were placed before the Regional Committee in its 408^th Meeting held on 12^th - 14^th April, 2024.

He submits that the applications of the petitioners shall be processed within a period of two months.

In view of the above, the respondents are directed to decide the petitioner’s application within a period of two months from today and it shall also be open for the respondents to call for any information, if necessary, in deciding the said applications of the petitioners.

Needless to state that this Court has not expressed any opinion on the merits of the petitioners’ claim. However, in case the petitioners are aggrieved by the decision taken by the respondents, it shall be open for the petitioners to seek legal recourse as permissible in law.

The petition stands disposed of in the above terms.
