The petitioner is a senior citizen who had filed an application under Rule 22(3)(1) of the Delhi Maintenance and Welfare of Senior Citizen Rules, 2009 seeking eviction of his son and daughter-in-law (respondent no.2) from the subject property being L-1/16, DDA Flats, Kalkaji, New Delhi-110019 before the District Magistrate, South East District, Government of NCT Delhi. Vide order dated 20.09.2024, the said application was allowed by the District Magistrate thereby directing the petitioner’s son and daughter in law to vacate the subject property within a period of three months.

Consequently, an appeal against the said order being Appeal No. 1023/2024 titled as ‘ Sakshi Shiva v. Santosh Kr. Shiva & Anr ’ was filed by

the respondent no.2 before the Divisional Commissioner / Appellate Authority under Rule 22(3)(4) of the Delhi Maintenance and Welfare of Senior Citizen Rules, 2009. It is stated that the appeal could not be taken up for hearing by the Divisional Commissioner on the last four dates, and the next date of hearing therein is fixed for 07.05.2025.

The limited prayer sought by the petitioner is that the concerned Appellate Authority which is seized of the appeal bearing no.1023/2024 filed by the respondent no.2 be directed to consider and decide the same expeditiously.

Considering the innocuous nature of the prayer, the present petition is disposed of with the request to the Appellate Authority to decide the aforesaid appeal expeditiously. Let an endeavour be made by the Appellate Authority to dispose of the said appeal within a period of 12 weeks from today, and the hearings be scheduled accordingly, under intimation to the petitioner.
