This writ petition is filed on behalf of the Petitioners under Article

226 of the Constitution of India seeking the following reliefs:-

¶14

“a) Issue an appropriate writ, order or direction declaring the demolition action on 15.06.2022 of the petitioners' houses as illegal, arbitrary, and unconstitutional;

¶15

b) Direct the respondents to pay adequate compensation to the petitioners for the loss caused due to illegal demolition of their residential house;

¶16

c) Direct the respondents to rehabilitate the petitioners or provide alternative housing/accommodation as per law;

¶17

d) Direct the respondents to open the gate of the street entry of the petitioners to entre in the house property of the petitioners.”

Respondents to pay adequate compensation as also to rehabilitate the Petitioners by providing alternate housing/accommodation.

Learned counsel for the Petitioners, at the outset, submits that a representation was made to the DDA as also other Respondents regarding the demolition action as also seeking compensation and alternate accommodation on 22.04.2025, however, till date the representation has not been decided, compelling the Petitioners to approach this Court.

Issue notice.

Counsels as above accept notice on behalf of the respective Respondents.

Learned Standing Counsel for Respondent No. 1/DDA, on instructions, submits that the representation of the Petitioners will be decided within a maximum period of 8 weeks from today.

Accordingly, without going into the merits of this petition, writ petition is disposed of directing Respondent No. 1 to decide the representation dated 22.04.2025 within a period of 6 weeks from today. The decision will be communicated to the Petitioners within one week from the date of decision and needless to state that if the Petitioners are aggrieved by the decision of Respondent No. 1, they will be at liberty to assail the same before the appropriate forum, if so advised and in accordance with law.
