Corporation of Delhi (“MCD”), to take action against respondent no. 10 for raising unauthorized construction in property bearing Khasra no. 1161/1 Min, Village Mehrauli, New Delhi-110030.

During the course of arguments, learned counsel appearing for respondent no. 10 has handed over to this Court details of the call record received from the petitioner with the number 9811107065 to submit that the petitioner has been calling up one of the associates of respondent no. 10 in order to blackmail the respondent no. 10. The record of the call handed over to this Court, is reproduced as under: -

of respondent no. 10 against the Delhi Development Authority (“DDA”). It is submitted that the petitioner herein has also filed an application of impleadment in the said suit.

Learned counsel appearing for the MCD further submits that the land in question has been inspected. He submits that no construction work was found to be carried out on the land in question.

Learned counsel appearing for the DDA, i.e., respondent no. 2 has handed over to this Court, photographs of the land in question. The said photographs are reproduced as under: -

By referring to the aforesaid photographs, learned counsel appearing for the DDA submits that no construction is going on the land in question. He further submits that as of now there is no encroachment on the DDA land.

Considering the submissions made before this Court, no orders are required to be passed in the present writ petition.

In normal course, this Court would have imposed cost on the petitioner considering the conduct of the petitioner. However, considering the fact that the petitioner is a practising advocate, this Court refrains from imposing any cost. Nevertheless, the petitioner is cautioned and shall refrain from undertaking any such activities.

Noting the aforesaid, the present writ petition, along with all pending application is disposed of.
