This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:-

“(i) Issue Writ of Mandamus or any other appropriate writ, order or direction, directing the National Testing Agency (Respondent No.2) to provide the score card/result of the Petitioner of NEET UG, 2020 expeditiously within a reasonable time frame so that the petitioner may appear in Forthcoming FMGE, the details of which are:

accept the score card/result issued by National Testing 22 agency (Respondent no.2) of Petitioner of NEET UG,2020, before this Hon’ble Court for forthcoming FMGE and subsequent FMGEs, and;

(iii) Issue Writ of Mandamus or any other appropriate writ, order or direction, directing National Board of Examination in Medical Science (Respondent no.1) and National Medical Council (Respondent no.3) to allow the candidature of the petitioner for the forthcoming Foreign Medical Graduate Examination(FMGE) and subsequent FMGEs on the basis of result/score card filed by the National Testing Agency (Respondent No.2) before this Hon’ble Court of Petitioner of NEET UG,2020, and;

(iv) Issue Writ of Mandamus or any other appropriate writ, order or direction, directing National Board of Examination in Medical Science (Respondent no.1) and National Medical Council (Respondent no.3) to allow the Petitioner to participate in forthcoming Foreign Medical Graduate Examination and subsequent FMGEs on the basis of score card/result issued by National Testing Agency (Respondent no.2) before this Hon’ble Court, of Petitioner of NEET UG,2020.

v) Pass any such further and/or other order(s) in the form of Writ as this Hon’ble Court deems fit and expedient in the facts and circumstances of the present matter.”

The grievance of the Petitioner is that she had enrolled for MBBS Course in foreign university and therefore, as required, she has to undertake an examination called Foreign Medical Graduate Examination (‘FMGE’), conducted by National Board of Examinations in Medical Sciences (‘NBEMS’). Learned counsel for the Petitioner submits that the process of applying for FMGE involves submission of NEET (UG) scorecard as a mandatory requirement, as outlined in the Information Bulletin issued by NBEMS for FMGE December-2025 Session as also future examinations. It is submitted that NTA has furnished requisite details and particulars of the Petitioner based on available database, which can be incorporated as a part of this order and direction can be issued to NTA to treat the order as a scorecard of NEET (UG), 2020 Examination, thereby dispensing with the

requirement on the part of the Petitioner to furnish the scorecard. Counsel for NTA fairly submits that similar orders have been passed by this Court in the past and NTA has no objection if this course of action is adopted in the present case.

I have perused the details furnished by NTA, which are as follows:-

Indisputably, similar orders have been passed by this Court and there is no reason to deny the reliefs sought by the Petitioner. Accordingly, NBEMS is directed to treat this order as scorecard of NEET (UG), 2020 Examination in respect of the Petitioner and consequently, requirement on part of the Petitioner to furnish scorecard for the FMGE December-2025 Session as also for future FMGE is dispensed with. Needless to state that in case Petitioner applies for FMGE henceforth, this order will be considered as compliance of the pre-condition of providing the scorecard.

Writ petition stands disposed of in the aforesaid terms along with the pending application.
