By way of this petition under Section 29A of the Arbitration and Conciliation Act, 1996, the petitioner seeks extension of the mandate of the learned Arbitral Tribunal, which is adjudicating disputes between the parties under an Agreement dated 11.05.2018.

The learned Arbitrator was appointed by an order of this Court dated 21.01.2022 in ARB.P. 1183/2021, and entered into the reference on 25.03.2022.

The parties are represented today. Learned counsel for the respondent states that the contents of the petition are not admitted inasmuch as the petitioner has cast some allegations upon the respondent for delay in the proceedings. However, he submits that the respondent also has a substantial counter-claim and is interested in the expeditious disposal of the proceedings.

I am informed that the arbitration proceedings are at the stage of evidence. As substantial period has already been spent in the proceedings, learned counsel for the parties assure the Court that they will cooperate with the learned Arbitrator for an expeditious disposal, and the learned Arbitrator is also requested to take up the matter as expeditiously as possible.

Having regard to the aforesaid submissions, the petition is allowed with the consent of learned counsel for the parties and the mandate of the learned Arbitral Tribunal is extended for a period of six months from today.

It is made clear that the contents of the petition are not taken to be admitted by the respondent.

The petition, alongwith pending application, is disposed of.
