The present petition under 226 of the Constitution of India read with Section 482 of the Cr.P.C seeks the following prayers:-

“a) Issue a writ of mandamus or any other appropriate writ, order or direction to the Respondents to conduct fair and proper inquiry in terms of the complaint dated 09.07.2022 lodged by the Petitioner in the office of SHO, PS: Shakarpur against acknowledgement as well as e-mail dated 20.07.2022 whereby the Commissioner, Delhi Police had acknowledged the complaint and referred it to the Special

Commissioner ofPolice/L&O(ZONE-I) vide Dy. No. is 52702/E-mail dated 20.07.2022, as well as Serious Fraud Investigation Office vide email dated 15.07.2022,and specifically all General Diary entries regarding the enquiry conducted till date and also to transfer the inquiry of pending complaint from local police to Economic Offence Wing, Delhi Police for fair, proper and unbiased inquiry/investigation within a fix time period and/or under the supervision of this Hon’ble Court. b) Issue a writ of mandamus or any other appropriate writ, order or direction to the Respondents for conducting an independent inquiry and fixing responsibility of concerned officials, who are responsible for causing delay in completing the inquiry on the complaint dated 09.07.2022 in terms of mandate of law; and

c) Pass any further order(s) which this Hon'ble Court deems fit and proper in the facts and circumstances of the present case, in the ~5 interest of justice.”

Learned Additional Standing Counsel, on instructions from Investigating Officer Satish Singh, P.S. Shakarpur submits that complaint to SHO P.S. Shakarpur dated 09.07.2022 has been inquired into and has been closed. Learned Additional Standing Counsel submits that the formal order of closure of the aforesaid complaint shall be supplied to learned counsel for the petitioner within three days. It is also stated that the complaint was inquired into by the officials from P.S. Shakarpur and the complaint was never transferred to EOW.

In view of the above, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition with liberty to initiate appropriate proceedings in accordance with law with respect to the present reliefs.

Leave and liberty granted.

The present petition is dismissed as withdrawn and disposed of.
