The present application has been field seeking regular bail in connection with FIR No. 85/2023 under Sections 420/467/468/471/120B/34 IPC registered at Police Station Maidan Garhi.

petitioner i.e. BAIL APPLN. 378/2024, this Court had directed the Jail Superintendent(s) to physically produce the petitioner herein from jail.

Pursuant to the said order, the petitioner has been physically produced before this Court. She has signed and filed an affidavit to the effect that she does not have any title or right in the disputed property. The same is taken on record.

In view of the fact that above affidavit has been filed, the learned counsel appearing on behalf of the complainant, without prejudice to his rights and contentions, submits that he has no objection in case the petitioner is enlarged on bail.

The learned APP for the State submits that since the complainant is satisfied and has no objection with regard to the grant of bail to the petitioner, the State also has no objection in case the petitioner is enlarged on bail.

In view of the above, the petitioner is enlarged on bail subject to his furnishing a Personal Bond in the sum of Rs. 20,000/- and one Surety Bond of the like amount to the satisfaction of the Trial Court/CMM/Duty Magistrate, further subject to the following conditions:-

a) Petitioner shall appear before the Court as and when the matter is taken up for hearing.

b) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.

c) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the witnesses.

The petition stands disposed of.
