It is seen that in all these writ petitions, there are interim orders directing the respondent-School to provisionally admit the petitioners. After the grant of the provisional admission, certain formalities were required to be completed by the petitioners.

Learned counsel appearing for respondent-School submits that without prejudice to the rights and contentions raised in the instant writ petitions and without going into the merit, at this stage, if the petitioners complete the said formalities and the respondent-Director of Education [“ respondent-DoE ”] approves their admission, the respondent-School does not have any objection to regularise the same.

Mr. Bhardwaj, learned counsel appearing for the respondent-DoE on the other hand, contends that if the respondent-School has any difficulty with respect to non-approval of the admission under the EWS category, an appropriate representation can be made to the respondent-DoE and the same will be considered in accordance with the law.

In view of the aforesaid, the petitions stand disposed of along with pending applications with the following directions:

i. Let the provisional admission granted to the petitioners be confirmed.

¶28

ii. Let the respondent-School to make a representation within 10 days from the date of receipt of the order passed today, to the respondentDoE requesting for the approval of the same.

iii. The respondent-DoE on receipt of such representation is directed to decide and pass an appropriate order approving the admissions to the petitioners under EWS category.

¶30

iv. Let the respondent-DoE to complete all formalities within 30 days from the date of receipt of the representation.

¶31

v. If there is any compliance to be made by the petitioners, let the same be also reported.

¶32

The liberty is granted to the respondent-School to take up appropriate proceedings if the respondent-DoE fails to adhere to the directions passed by this Court.
