The present writ petition under Articles 226 and 227 of the Constitution of India seeks to assail the order dated 11.10.2023 passed by the learned Central Administrative Tribunal in O.A. 2532/2015. Vide the impugned order, the learned Tribunal after considering the matter at length and taking into account the role attributed to the respondent has come to the conclusion that the penalty imposed on the respondent was highly disproportionate and consequently, remanded the matter back to the Appellate Authority of the petitioner for re-consideration of the penalty imposed on the respondent.

Having perused the impugned order and the findings of the learned Tribunal from which it clearly emerges that the respondent was not the main person who was responsible for the lapse attributed to the Escort Party, of which the respondent was only one of the members,
