This writ petition has been preferred on behalf of the Petitioner under Article 226 of the Constitution of India seeking quashing of unpublished list of candidates selected through seniority channel vide order dated 01.06.2024 with respect to Shimla area as being violative of Master Circular 494/2020 as also to quash promotion and circle allocation to the Petitioner through selectivity challan vide order dated 03.06.2024 as being violative of Master Circular 494/2020. A writ of mandamus is also sought for a direction to the Respondent to grant promotion to Petitioner w.e.f. 01.04.2024, amongst other reliefs.

There is no dispute on a plain reading of the writ petition that the Petitioner seeks his promotion through a particular channel. As per the averments in the writ petition, no representation has been preferred to challenge the impugned action. During the course of hearing, learned counsel for the Petitioner states that the Petitioner has filed a representation on 17.07.2024 to the Chief Liaisoning Officer, Head Office, New Delhi, albeit there is no mention of the same in the writ petition nor a copy has been appended.

Be that as it may, at this stage, without entering into merits of the case, this writ petition is disposed of by directing the Respondent to treat this writ petition as a representation and take a decision within a period of four weeks from the date of receipt of this order. Needless to state that decision will be taken keeping in mind the Master Circular 494/2020 which is allegedly violated by the Respondent governing promotions on seniority as well as on merit/selectivity channel. The decision will be a reasoned and speaking order and shall be communicated within one week from the date of decision to the Petitioner, who will be at liberty to take recourse to legal remedies in case of any surviving grievance.
