Present public interest litigation has been filed seeking a direction to Bureau of Indian Standards (BIS)/respondent no. 1 and Delhi Police/respondent no. 2 to curb the sale of non-BIS certified helmets and to undertake awareness programmes to educate the public about importance of BIS certified helmets.

The petitioner, who appears in person, states that the Ministry of Road, Transport and Highway, vide notification dated 26^th November, 2020

(“the notification”), has made the Standard Mark BIS mandatory for helmet for riders of two-wheeler motor vehicles. He states that as per the said notification, BIS is the authority for certifying and enforcing the Standard Mark for helmets. He however states that despite the said notification, nonBIS and fake helmets are being sold in the market, thereby putting the lives of two-wheeler riders at risk. He states that he has made several complaints to the respondents, but no action has been taken so far.

A perusal of the paper book reveals that the complaints made to the BIS and Delhi Police are bereft of material particulars. In fact, a perusal of the complaints made to BIS shows that the petitioner has been unable to point to a single instance of sale of non-BIS helmet. Similarly, the complaint made to the Commissioner of Police, Delhi Police is general, vague and not actionable in nature.

Consequently, the present writ petition is disposed of with liberty to the petitioner to file a detailed representation giving material particulars and instances of sale of non-BIS helmets. With the aforesaid liberty, the present writ petition stands disposed of.
