The respondent No. 2 has not been served and no steps have been taken by the appellant for the service of the respondent No.2 in terms of the order dated 9.8.2018 whereby it is indicated that the respondent No.2 had not been served even for the date 9.8.2018 with the last opportunity having been granted to serve the respondent No.2 with it having been directed failing which consequential orders would follow, no steps have been taken by the appellant for service of the respondent No.2 and there being no representative also on behalf of the appellant, the RSA No. 170/2017 is thus dismissed for nonprosecution and the interim order dated 11.7.2017 is thus vacated.
