By this petition the petitioner seeks furlough for a period of three weeks to maintain social ties.

As per the nominal roll the petitioner is being granted regular paroles and the last parole was granted w.e.f. 22^nd November, 2017 for a period of four weeks by this Court which concession the petitioner has not misused. When a status report was called in the present petition a report was submitted based on the statement of wife of the petitioner who stated that when the petitioner comes out on parole, he spends money in drinking and thereafter misbehaves with her and the children.

Faced with this situation the petitioner who was produced in Court on the last date of hearing stated that if released on furlough he will stay with W.P.(CRL) 460/2018 Page 1 of 2

his father and not with the wife and children. A further status report has been filed. As per the status report father and brother of the petitioner were contacted who stated that they would take responsibility of the petitioner and he would be residing with his father during the period of parole at Bullanshehar, U.P. and not in Ghaziabad, U.P.

Since the petitioner has now been in continuous custody since the year 2007 except for brief spells of interim bail/paroles for the last three years, this Court deems it fit to grant furlough to the petitioner as the conduct of the petitioner in jail is satisfactory.

Consequently, the petitioner is directed to be released on furlough for a period of three weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount, which surety would be of a family member of the petitioner, subject to the satisfaction of the learned Trial Court further subject to the condition that the petitioner would reside with his father at Bullandshehar, U.P. and will not visit or in any manner intimidate his wife and children, who are residing at Ghaziabad.

Petition is disposed of.

Copy of the order be communicated to the petitioner through Superintendent, Mandoli Jail.
