By way of this application filed under Section 439 Cr.P.C., the
petitioner is praying for release on regular bail in FIR No.74/2018, under Sections 420/468/471/120-B IPC, registered at PS Madhu Vihar.
Learned counsel for the petitioner states that the petitioner has been falsely implicated in this case. There is nothing against the petitioner except the confessional statement of co-accused and petitioner’s own confessional statement. No independent material could be collected during the investigation to show the complicity of the petitioner with the offences alleged. It is submitted that all the co-accused have been granted bail and petitioner is in custody for more than six months.
Learned counsel for the petitioner submits that charge-sheet has been filed and petitioner is not required for any further investigation. Petitioner may be released on bail.
