This petition has been suo moto registered by this Court as PIL on the basis of the letter dated 05.04.2013 received from Ms. Geeta, wife of Shri Raj Kumar stating that her daughter aged 7 years was assaulted sexually in the school and that though the matter was reported to police, the identity of the accused could not be fixed by the police.

In pursuance of the notice ordered, the SHO, Mangol Puri PS filed a status report stating that FIR No.137/13 was registered under Section 376(1)/376(2)(h)/506 IPC and since the investigation of the staff members, employees, regular visitors of the school and other steps did not yield any result, untraced report was filed in the court. Having perused the status report, by order dated 29.04.2015, we directed that re-investigation be done by the Crime Branch.

On 08.07.2015, the Asst. Commissioner of Police, Northern Range, Crime Branch, Delhi filed a status report explaining the steps that have already been taken and stating that sincere efforts are being made to trace and apprehend the accused. A fresh status report was filed on 09.12.2015 by the Asst. Commissioner of Police, Northern Range, Crime Branch stating that the investigation is still in progress. On 03.02.2016, another status report dated 31.12.2015 was filed together with the report of Forensic Science Laboratory, Government of NCT of Delhi.

Mr. Kailash Chandra, ACP, Crime Branch (NR), Delhi filed an affidavit dated 08.03.2016 explaining that the matter is being monitored by him on regular basis and that though nothing new has been revealed so far, the investigation is still in progress and sincere efforts are being made to apprehend the accused.

Having perused the material available on record, we consider it appropriate to dispose of the writ petition with a direction to the respondents to take all necessary steps in accordance with law to trace and apprehend the accused. The writ petition is accordingly disposed of.
