Harbir Singh Vs State (Nct) of Delhi & Ors.

Present writ petition has been filed seeking a direction to respondent nos. 2 and 3 and their officials not to harass of the petitioner and to allow him to carry on his trade at the allocated tehbazari site at 10197, Santi Building, Gali No. 16, Beedanpura, Karol Bagh, New Delhi – 110005.

It has been averred that the petitioner was granted tehbazari site in pursuance to the order dated 25^th May, 2005 passed by this Court in W.P(C) No. 5277/2005.

Learned counsel for the petitioner states that the police officials along with respondent no. 5, who is a self-styled pradhan of Karol Bagh Merchant Association, have been harassing the petitioner and not letting him do his business at his tehbazari site and the action of respondent no. 4 and 5 is causing immense hardship to the petitioner.

A perusal of the paper book reveals that the petitioner’s

complaint dated 6^th January, 2016 has not been disposed of till date. Consequently, the present writ petition is disposed of with a direction to DCP (Central), Darya Ganj, Delhi to decide the petitioner’s complaint dated 6^th January, 2016 within a period of two week.

With the aforesaid direction, the present writ petition along with the application is disposed of.

In the event, the petitioner is still aggrieved by the decision of the DCP (Central), Darya Ganj, Delhi, it shall be open to the petitioner to file an appropriate proceeding in accordance with the law.
