The petitioner has filed the present writ petition praying for the following reliefs:

10.1 That, this Hon’ble Court may kindly be pleased to allow this writ petition and direct the respondents authorities be directed to dispose of the petitioner submitted by the application dated 15.04.2024, 02.04.2025 and 19.02.2026 regarding the withholding of his outstanding salary and increments.

10.2 That, this Hon’ble Court may kindly be pleased to pass any other order or relief as this Court may deems fit and proper in the interest of justice with cost of the petition.

Counsel for the petitioner submits that the petitioner while working on the post of A.G.-III in the office of District Collector, Korea. He was implicated in criminal case and was arrested. Upon arrest of the petitioner, he was suspended and thereafter on the appeal preferred against the order of suspension, the Commissioner, Sarguja Division has revoked the order of suspension and reinstated the petitioner however in the said order, it has been stated that the decision on the period of suspension shall be taken after decision of the criminal case. Now the criminal case has been decided and the petitioner has been acquitted from the charges vide order dated 06.03.2024 (Annexure P/2). Petitioner thereafter submitted a representation before the Collector,

Surajpur with whom as of now the petitioner is working. The representation is submitted on 19.02.2026 however no decision is taken, therefore directions be issued to the respondent no. 4 to consider and take decision on the pending representations at the earliest.

Counsel for the State in view of the limited prayer made by the counsel for the petitioner is having no objection.

I have heard learned counsel for the parties.

On due consideration of submission of counsel for the respective parties, this writ petition at this stage is disposed of permitting the petitioner to submit a fresh comprehensive representation before respondent no. 3 and 4 and in the event such a representation is submitted, concerned authority shall consider and take decision on the representation submitted by the petitioner along with pending representation in accordance with law expeditiously preferably within a period of 2 months from the date of receipt of the order.
