The petitioners have preferred this writ petition under Article 226 of the Constitution of India seeking following reliefs :-

“10.1 That, this Hon'ble Court may kindly be pleased to call

for the entire record pertaining to the case of the petitioner.

10.2 That, this Hon'ble Court may kindly be pleased to allow the petition and kindly direct the respondent authorities to shift the electricity poles which have already been installed in the land of petitioners.

3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to shift the complete project of poles installation from the land of petitioners as government lands are situated adjacent to the land of petitioners.

0.4 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to provide compensation to the petitioners as they have misused the land of petitioners without even intimating them.

10.5 That any other relief, which this Hon'ble Court may deem fit and proper together with cost of the petition.

Learned counsel for the petitioners submits that, petitioners are having agricultural land bearing Khasra No. 337/12, 337/24, 337/26 and 337/27 total Khasra no. 4, total area 2.632 hectare situated at PH No. 34, R.N.M. Arjuni, village Bankhedi, Block and Tahsil Dongargaon, Distt. Rajnandgaon (CG). She further submits that respondents No. 1 to 4 have erected electric polls on said land of the petitioners without their consent, whereas 200 ft away from petitioners land in north side, there is a government land, hence the electric polls may be shifted on that government land. Learned counsel also submits that, petitioners have filed application dated 22-1-2021 before the respondent No. 4/ Executive Engineer (Civil), Civil Division, CSPTCL, Bhilai – III, Distt.

Durg (CG) for redressal of their grievance, but the same has not been decided yet, therefore, at this stage, she submits that, this writ petition may be disposed of directing the respondent No. 4/ Executive Engineer (Civil), Civil Division, CSPTCL, Bhilai – III, Distt. Durg (CG) to decide their representation as early as possible.

Learned counsel for the respondents have no objection to allow above limited prayer.

Heard learned counsel for the parties and perused the material available on record.

Having considered the limited prayer made by learned counsel for the petitioners, this petition is disposed of at this stage, directing the respondent No. 4/ Executive Engineer (Civil), Civil Division, CSPTCL, Bhilai – III, Distt. Durg (CG) to decide the application dated 22-1-2021 filed by the petitioners as early as possible preferably within a period of 90 days from the date of receipt of a copy of this order. Petitioners are also directed to file a copy of this order along with copy of application dated 22-1-2021 before the respondent No. 4 within 15 days from today.
