The petitioner has filed this writ petition under Article 226 of the Constitution of India for enhancement of the compensation with regard to the land situated at Village - Nirtu, Patwari Halka No. 53, Tahsil - Takhatpur, District - Bilaspur (C.G.) as the land of the

petitioner has already been acquired for construction of National Highway.

Since the petitioner’s land has already been acquired for construction of National Highway, therefore, the petitioner is at liberty to move an application before the Commissioner, Bilaspur (C.G.) for raising his grievances with regard to quantum of the compensation who has been appointed as Arbitrator under Section 3G(5) of the National Highways Act, 1956. If the same same is submitted by the petitioner within one month from the date of receipt of copy of the order, neither the Arbitrator nor the respondent shall take plea of limitation and the Commissioner so appointed under Section 3G(5) of the National Highways Act, 1956 will decide the case on its own merit.

With aforesaid observation and direction, the writ petition is disposed of.
