Learned counsel for the respective respondents raises objection with regard to maintainability of both the petitions and would submit that in the facts of the case, nature of dispute raised by the petitioners, the petitioners are having efficacious remedy available under Section 76 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act, 2013 (herein after refereed as ‘Act, 2013’).

Learned counsel for the petitioners submit that the petitioners have purchased the land subject matter of acquisition through registered sale deed from one of its joint owner of the property and their name were also recorded in the revenue records, however, at the time of initiation of land acquisition proceeding and passing of the award, name of petitioners have neither been mentioned in the proceedings nor in the award, he however submits that in view of the objections raised by learned counsel for the respective respondents, he may be permitted to withdraw both the writ petitions with liberty to avail other remedy available under Act, 2013.

In view of the submission made by learned counsel for the respective parties, both the writ petitions are disposed of reserving liberty to the petitioners to avail other remedy available under Act, 2013 for redressal of their grievance, as have been raised in the respective petitions.

With the aforesaid observation, direction and liberty to the petitioners, both these writ petitions are disposed of .
