1. The petitioner has preferred this writ petition under Article 226 of the Constitution of India, seeking following reliefs:-

“10.1 That, this Hon'ble Court may kindly be pleased to declare that the acquisition proceedings initiated under Notification No. Acquisition-288-A-82-89-90 dated 07.09.1990, as well as the award dated 10.06.1991, lost their legal effect after the cancellation of the said notification and issuance of the fresh notification.

10.2 That this Hon'ble Court may be pleased to direct the respondents to reassess the compensation for the petitioner's land (Khasra Nos. 85/11 and 85/20, Village Dangania, Raipur) in accordance with the current market value, in compliance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, with interest from the date of taking possession to the actual payment of compensation.

10.3 That this Hon'ble Court may be pleased to direct the respondents to revert the land area 1004 sq.ft. of khasra no. 85/11 to the petitioner.

10.4 That this Hon'ble Court may be pleased to grant possession of the petitioner's land or, in the alternative, provide vacant land of equivalent value and area in the same locality to the petitioner.

10.5 That this Hon'ble Court may be pleased to award any other relief, including costs of the petition, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.”

Learned counsel for the petitioner submits that the petitioner is recorded owner of Khara No.85/11, area 2300 sq. ft. and Khasra No. 85/20 area 3280 sq. ft.; total area 5580 sq. ft. situated at village Dangania. Aforesaid land of the petitioner has been acquired by the then Govt. of Madhya Pradesh. But as per notification (Annexure-P/3), only 4380 sq.ft (0.10 decimal) land was acquired, but the petitioner is not aware about the remaining 1200 sq. ft. of aforesaid land. Therefore, learned counsel for the petitioner seeks permission of the Court to withdraw this petition with liberty to file representation before the respondents 2 to 4 for redressal of all his grievances.

3. Learned counsel for the respondents have no objection on the aforesaid prayer of the petitioner.

4. On due consideration, the prayer is allowed. However, liberty is granted to the petitioner to file representation before respondents 2 to 4/competent authority, within 15 days from today. In the eventuality of filing such representation by the petitioner, the same shall be decided accordingly.

5. With aforesaid observation, present petition stands disposed of.
