By way of the present appeal under Order 43 Rule 1(u) of the Code of Civil Procedure, 1908 (for brevity, “the CPC”), the appellant/defendant has challenged the impugned order dated 02.12.2022 passed by the learned First Additional District Judge in Civil Appeal No. 59A/2018 (Smt. Chamrin Bai vs. Sakharam

and Others), whereby the matter has been remanded to the trial Court.

At the very outset, learned counsel for the appellant submits that, pursuant to the remand order passed by the First Appellate Court, the evidence has already been adduced by the parties in the civil suit and the suit is now fixed for pronouncement of judgment. Therefore, it is prayed that the present appeal be disposed of with a direction to the trial Court for expeditious disposal of the civil suit.

Learned State counsel has no objection to the aforesaid submission made on behalf of the appellant.

Considering the submissions made and the fact that, after the remand order passed by the first appellate Court, the civil suit has reached the stage of judgment, hence no useful purpose would be served in keeping the present appeal pending.

Accordingly, the appeal is disposed of with a direction to the trial Court to pronounce the judgment expeditiously, in accordance with law.

With the aforesaid direction, the present appeal stands disposed of.
