This Contempt Petition has been filed by the petitioner under Article 215 of the Constitution of India for non-compliance of order dated 10.11.2023 passed by this Court in WPC No.4751/2013 (Dr. Anupama Asthana Vs. M/s Care and Cure Associates).

Vide order dated 10.11.2023 passed in WPC No.4751/2013 the co-ordinate Bench of this Court has passed the following order:-

" 5. Considering the submission made by respective parties, as also the fact that the petitioner has filed the application under Section 12 of Act of 2011 in the month of April, 2022,

submission of learned counsel for petitioner is that the evidence is still to be recorded by Rent Controlling Authority, I find it appropriate to dispose of this writ petition at this stage directing the Rent Controlling Authority to conclude the proceedings within a further period of six months from the date of receipt of the order."

Perusal of aforesaid would show that the Co-ordinate Bench has directed the respondent-Rent Control authority, Raipur to decide Case No.66 of 2021-22 (Dr. Anupama Asthana Vs. M/s. Care and Cure Associates) within a period of six months from the date of receipt of aforesaid order.

Learned counsel for the petitioner submits that he has produced the copy of order passed the co-ordinate Bench before the Rent Control Authority on 30.11.2023, despite that the aforesaid case has not been decided yet and further date has been given by the Rent Control Authority for evidence. He prays that at this stage this petition may be disposed of and an appropriate direction may be issued to the respondent for early disposal of the pending case.

Having regard of the prayer of learned for the petitioner and order passed by this Court in WPC No.4751/2023, it is directed that respondent-Rent Control Authority shall decide the Case No.66 of 2021-22 pending before him in expeditious manner, preferably within a period of 3 months from the date of receipt of copy/submission of this order, else in the event filing of subsequent contempt petition, strict view shall be taken against him.

With the aforesaid direction, this petition stands disposed of.
