pleased to direct the respondent No.2 to consider and decide the claim of petitioner for grant of Bhumiswami/patta in respect of land bearing khasra No.670 admeasuring area 0.05 hectare land situated at Village Hathkhoj, Tahsil-Rajim, District Gariyaband [C.G.], in view of provisions of Chhattisgarh Krishi Prayojan Ke Liye Upyog Ki Ja Rahi Dakhalrahit Bhumi Par Bhumiswami Adhikaron Ka Pradan Kiya Jana [Vishesh Upbandh] Adhiniyam, in accordance with law. 10.2 To kindly grant any other relief which may deem fit in the given facts and circumstances of the instant case.”

Learned counsel for the petitioner submits that the petitioner is a landless person and has been in possession over the land bearing Khasra No.608, area 0.50 hectare situated at Village Fuljhar, Tahsil Fingeshwar, District Gariyaband (CG), for several decades. The petitioner has upgraded the said land and has been carrying out agricultural activities thereon. He further submits that the petitioner has also moved an application dated 04.11.2025 (Annexure -P/3) before the Collector, District Gariyaband (respondent No.2) seeking grant of patta under the Chhattisgarh Krishi Prayojan Ke Liye Upyog Ki Ja Rahi Dakhalrahit Bhumi Par Bhumiswami Adhikaron Ka Pradan Kiya Jana [Vishesh Upbandh] Adhiniyam, 1984 (henceforth referred to as “Adhiniyam, 1984”, but the same has not been decided till date. Therefore, learned counsel prays that this petition may be disposed of with a direction to respondent No.2-Collector, District Gariyaband (CG) to decide the aforesaid application (Annexure-P/3) expeditiously.

shall be considered and decided by the concerned Collector in accordance with law.

Considering the aforesaid facts and circumstances of the case, the present petition is disposed of at this juncture directing respondent No.2-Collector, Gariyaband to decide the application dated 04.11.2025 (Annexure-P/3) filed by petitioner under the Adhiniyam, 1984, strictly after due verification, scrutiny and enquiry, if required under law, expeditiously and preferably within a period of six months from the date of receipt/submission of a copy of this order.

With aforesaid observation and direction, this writ petition stands disposed of .
