The limited grievance the petitioner is having in the present writ petition is the non granting of the benefit of time scale pay on completion of 8 years and 16 years of service and also not granting upgradation of the pay-scale which he was entitled for having put in a particular length of service under the service regulations and circulars governing the field.

According to the counsel for the petitioner, petitioner was working under the respondents as an Assistant Development Commissioner and ex-officio Chief Executive Officer, Janpad Panchayat. The contention of the counsel for the petitioner is that upon completion of 8 years and 16 years of service, he

would have been entitled for the benefit of time scale pay in terms of circulars governing the field at that point of time which has not been granted to him.

Given the said facts and circumstances of the case, the writ petition at this juncture is disposed of directing Respondents No. 1 & 2 to immediately scrutinize the claim of the petitioner so far as the grant of time scale pay to the petitioner while he was in service and to take an appropriate decision after due verification of the entitlement part at the earliest preferably within a period of three months from the date of receipt of copy of this order.
