This Writ Petition under Article 226 of the Constitution of India has been filed for the following reliefs:-

10.1 That the Hon’ble Court may kindly be pleased to direct the respondent to provide (pension, gratuity and leave encashment amount and other benefits) with interest @ 8 % from the date of entitlement of such dues till the date of actual payment.

10.2 Any other relief which this Hon’ble Court may deem fit and proper may also be passed in favour of the petitioner.

At the outset, learned counsel for the petitioner submits that the present petition may be disposed of reserving liberty in favour of the petitioner to prefer a fresh representation raising all his grievances before the Respondent No.3-District Education Officer, Korba who in turn shall decide the said representation within a stipulated time frame.

Considering the limited prayer made by the petitioner, it is directed that if the petitioner prefers a fresh representation within a period of 30 days of this order, Respondent No.3-District Education Officer, Korba shall consider and decide the same by a speaking order within 120 days from the date of filing of said representation, in accordance with law.

With the aforesaid direction, this Writ Petition stands disposed of.
