“1. That, this Hon’ble Court may kindly be pleased to direct the respondent authorities consider the representation and to pay compensation amount on account of death of the deceased as per circular of the Government, within stipulated time, in the interest of justice.

That, this Hon’ble Court may kindly be pleased to issue similar order as per Annexure P-5, in the interest of justice.

Any other relief which may be suitable in the facts and circumstances of the case, may also be granted, in the interest of justice.”

Learned counsel for petitioner submits that wife of petitioner Late Rina Kosariya died due to electric current. Petitioner thereafter, submitted a representation before respondent no. 3/Executive Engineer seeking compensation in accordance with the circular issued in this behalf, however, representation submitted by petitioner vide Annexure P-1 dated 03.03.2023 has not been decided till date, therefore, direction be issued to concerned authority i.e. respondent no. 3 to take decision on pending representation, expeditiously.

Learned counsel for State opposes the submission made by learned counsel for petitioner and further submits that claim of the petitioner is against respondent no. 1 to 4.

I have heard learned counsel for respective parties and perused the document enclosed along with this writ petition.

As petitioner is not seeking decision on merits of claim but is only seeking direction to respondent no. 3 to take decision on pending representation, I find it appropriate to dispose of this writ petition at this stage without issuing notice to respondents no. 1 to 4, directing respondent no. 3 to take decision on pending representation submitted by petitioner Annexure P-1 dated 03.03.2023, expeditiously, on its own merit, preferably within a further period of three months from the date of receipt of copy of this Order.

Considering date of submission of representation by petitioner before the respondent no. 3, petitioner will be at liberty to file fresh representation along with the order and, if such representation is submitted, concerned authority shall consider and take decision on fresh representation along with pending representation.

With the aforesaid direction, this writ petition is disposed of.
