The petitioner has filed this writ petition seeking following reliefs:-

“10.1 That, the Hon’ble Court may kindly be pleased to set-aside the impugned order dated 07.01.2022

passed by the Collector, Bijapur, District – Bijapur Chhattisgarh and further may be pleased to direct the respondent authorities to grant compensation in lieu of acquiring land of the petitioner with interest in the interest of justice.

10.2 Any other relief which may be suitable in the facts and circumstances of the case, may also be granted, in the interest of justice.”

Learned counsel for the Respondents/State submits that the main grievance of the petitioner is with regard to grant of compensation as computed by the Land Acquisition Officer in lieu of the land acquired for the purpose of construction of pond. He contended that at the time of acquisition proceedings, the land was recorded in the name of one Sangamlal and therefore, after passing of the award, amount of compensation computed has been disbursed in favour of one Sangamlal in the year 1982.

Learned counsel for the petitioner submits that petitioner have purchased the land from Sangamlal and therefore, the land purchased by the petitioner if it is acquired for the purpose of construction of the pond, then, the petitioner ought to have been given the compensation.

Learned counsel for the Respondents/State submits that the acquisition proceedings culminated in the year 1982 and only thereafter, the saledeed was executed in favour of the petitioner by way one Sangamlal after accepting the amount of compensation.

I have heard learned counsel for the parties and also perused the documents placed on record.

The date of purchase of the land by the petitioner in the year 1984 is not disputed by the counsel for petitioner. In view of the aforementioned facts and circumstances of the case, submission of counsel for the respective parties and nature of grievance raised, no relief as prayed for by the petitioner in this petition can be granted, accordingly, the writ petition is

dismissed . However, the petitioner will be at liberty to take recourse to law as available to the petitioner for recovery of the amount, if any from the private person.

With the aforesaid observation and directions, this writ petition stands
