Learned State counsel submits that grievance of petitioner is that no decision has been taken on the claim of petitioner for releasing the fund of Rs.6,46,800/-, which the petitioner expended in the Mount Kosciuszko Expedition. He submits that pursuant to the letter (Annexure P-6), decision has been taken and the claim of petitioner is rejected, therefore, no relief as prayed for in this petition can be granted.

Petitioner submits that in view of submission made by learned State counsel that claim of petitioner has been rejected by the authority, he may be permitted to withdraw this writ petition with liberty to file fresh petition challenging the decision of the authorities rejecting the claim of petitioner. He further submits that State Counsel be directed to supply the relevant documents which he obtained from the authorities pursuant to the order passed by this Court.

Learned State counsel submits that he will supply one set of copy of documents, which he has received from the competent authority as instructions during the course of the day.

In view of the above submission made by learned counsel for respective parties, this petition is dismissed as withdrawn with liberty as prayed for.
