By way of this petition, the petitioner has sought for the following relief :-

“10.1 A writ or an order in the nature of appropriate writ do issue calling the relevant records pertaining to the case of the petitioner from the court below concerned for its kind perusal.

10.2 A writ or an order in the nature of appropriate writ do issue setting aside the order dated 13.12.2023 Ammexure P/1 and the order dated 14.10.2024 Annexure P/2 being illegal, arbitrary and perverse and in consequence thereof this Hon’ble Court may kindly please to restrain the respondence from taking any steps towards alienation or sale of the subject property til the disposal of the suit.

10.3 That the Hon’ble Court may be pleased to grant any other relief(s)/ order(s)/ direction(s) in Favour of petitioner, which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.”

Learned counsel for the petitioner submits that petitioner is only seeking a direction to expedite the proceeding of Civil Suit No. A- 51A/2023 which remains pending before learned First Civil Judge, Class-II, Raipur (C.G.) since 31.01.2023.

Taking into consideration the limited prayer made by petitioner, this petition is disposed of directing the concerned trial Court to make all endeavors to conclude the proceeding of pending Civil Suit No. A- 51A/2023 expeditiously.
