1. Since common questions of law and facts are involved in these writ petitions, therefore, they are clubbed together, heard together and finally disposed of by this common order.

2. Brief facts of the present case are as under:-

A. The petitioners were initially appointed to the post of Assistant Professors through an examination conducted by the Chhattisgarh Public Service Commission.

¶352

B. The services of the petitioners were governed by the Chhattisgarh Education Service (Collegiate Branch) Recruitment Rules, 1990 (for short "Rules, 1990").

C. Schedule IV makes it clear that the candidates who have a PhD and

13 years of experience in the post of Assistant Professor and have

made some mark in the areas of scholarship and research as evidenced by self-assessment and reports of reference of quality publication; contribution to educational renovation; design of new courses and curricular, would be considered for promotion to the post of Professor.

D. In the Rules, there is no provision for the distribution of marks for each of the qualifications prescribed under 3(c) of Schedule-IV.

E. No steps were taken by the department for promotion to the post of Professor from the post of Assistant Professor, therefore, Writ Petition (WPS 5028/2010, Dr. Sanjay Tiwari & Ors. v. State of Chhattisgarh), was preferred before this Court, which was disposed of with a direction to the Respondent authorities to consider the claim of the Assistant Professors for promotion according to the Rules, 1990 & 2003.

F. Contempt petitions were also filed.

¶360

G. Rule 15 of Schedule-IV of the Recruitment Rules, 1990 provides that Assistant Professor working in the Senior/Selection grade pay scale would be eligible for promotion to the post of Professor, if he or she has made some marks in the areas of scholarship and research as evidenced by self assessment, etc.

H. The Commissioner Higher Education has applied the criteria of external academic valuation and the marks were fixed to ascertain the internal merits of the candidates, whereas, such criteria were not a part of the Rules, 1990. Such criteria were laid down by respondents No. 1 & 2 without there being any legal backing.

I. On 19.08.2016, about 26 Assistant Professors were promoted to the post of Professors out of 792 eligible candidates, but the claims of the petitioners were not considered for promotion.

J. As per the original scheme of eligibility criteria for promotion contemplated in the Rules, 1990, it was required that work done in the field of scholarship and research would be considered, which could be ascertained by self-rating, report of referee, quality of publication, innovation in teaching, designing of new courses and curriculum etc.

K. Respondent No. 1 introduced a new marking scheme through an internal committee, allocating arbitrary marks for various achievements, such as authoring books or publishing research papers. This scheme

bypassed the Departmental Promotion Committee's role under the Rules of 2003.

L. The Petitioners made representations, but no action was taken. Thereafter, the present writ petitions were filed.

Learned counsel appearing for the respective petitioners submitted that under the Rules, 1990, the Petitioners were entitled to promotion between 2006-2008, but no promotion was granted by the respondent authorities, therefore, they are seeking their promotion to the post of Professor in their respective subjects, as they have already submitted the requisite documents before the Departmental Promotion Committee (for short, "DPC") for consideration of their names for promotion to the post of Professor. However, the authorities have informed that the documents of some of the petitioners were not received, therefore, they were not found eligible. It is contended that a question was raised in the State Legislative Assembly, and it was answered/confirmed that 24 Assistant Professors had submitted their application forms along with the requisite documents before the DPC, but it was stated by the respondents that some of the petitioners failed to submit the relevant documents. They further submitted that the authorities/DPC have altered/changed the rules of promotion contrary to the regulations of the University Grants Commission (for short, “the UGC”); thus, a direction may be issued to the respondent authorities to reconsider the eligibility of the petitioners by holding review DPC, and if they are found eligible for promotion to the post of Professor in their respective subjects, they may be promoted in accordance with the law and prevailing rules from the date when other candidates/incumbents were promoted.

4. On the other hand, the learned counsel appearing for the State and

the learned counsel appearing for the Chhattisgarh Public Service Commission (CGPSC) contended that due diligence was exercised by the DPC, and the candidates who were found eligible, were granted promotion. They further contended that the petitioners did not meet the requisite qualifications and failed to submit the necessary documents, including research publications, etc., therefore they were not declared ineligible. They also contended that the DPC would consider the candidature of the petitioners in the light of the observations made by this Court if this Court directs the DPC / the concerned respondent authorities to conduct a review DPC and reconsider the eligibility of the petitioners for the promotion.

5. Learned counsel appearing for the rest of the respondents would support the arguments advanced by the counsel for the State and the CGPSC.

6. I have heard the learned counsel appearing for the parties and perused the documents placed on the record.

7. In the present case, after the establishment of the State of Chhattisgarh, the first Departmental Promotion Committee (DPC) was conducted on 11.05.2006. Out of 380 candidates falling within the zone of consideration, 134 were recommended and promoted to the post of Professor. A review DPC was conducted on 23.07.2007, where 368 out of 380 candidates were recommended and promoted. Subsequently, a seniority-wise gradation list was published on 01.04.2012. The candidates falling within the zone of consideration for promotion to the post of Professor approached this Court by filing WPS No.5028 of 2010, seeking a direction to the authorities to consider their names for promotion strictly in accordance with the Rules of 1990 and 2003.

8. The marking scheme was considered by the DPC on 01.01.2013. The petitioners of WPS No. 5028 of 2010 filed a Contempt Petition on 01.04.2013 (Contempt Petition No.215 of 2013). In response, respondent No.1 filed an affidavit stating that the grievances of the petitioners would be considered without amending the Rules of 1990. Thereafter, respondent No.1 sent a proposal for the promotion of Assistant Professors to the post of Professors to respondent No. 2 on 18.11.2013. Furthermore, the Commissioner issued a circular to all the Principals of Colleges regarding the UGC amendment and the API scheme on 26.03.2014, with a note that the new API scheme was introduced under the UGC Regulations of 2010, amended on 13.06.2013, would be implemented through a letter without any formal amendment or publication.

9. Respondent No.1 issued a letter to the Commissioner regarding the UGC amendment and API scheme on 07.04.2014. On 14.07.2014, upon the assurance of respondent No.1, the contempt proceedings were dropped. However, a second contempt petition was filed on 15.04.2015. On 11.05.2015, respondent No. 1 sent a list of integrity certificates of candidates who were within the zone of consideration for promotion to respondent No. 2. A member of the technical committee, Tilak Sengupta, introduced the marking scheme.

10. On 03.10.2015, the Additional Director issued a circular directing Assistant Professors to submit details as per Schedule-IV of the Rules, 1990. Subsequently, on 20.10.2015, the records and documents were submitted by the Assistant Professors, but the documents of 8 out of 24 candidates were declared as not received.

11. On 30.11.2015, information regarding the promotion criteria under

Schedule-IV of the Rules, 1990 was revealed. On 08.03.2016, the DPC directed respondent No.1 to seek an opinion from subject experts on account of submissions of bulky documents by the candidates.

12. On 03.06.2016, a new marking scheme was introduced by the authorities, which was neither included in the recruitment rules nor in the UGC Regulations. On 06.06.2016, respondent No.1 communicated with the Additional Director to evaluate the documents submitted by the candidates and marks for 303 candidates were categorized.

13. On 27.06.2016, respondent No.1 directed respondent No.2 to complete the evaluation and conduct the DPC. The DPC was convened on 01.07.2016, where respondent No. 2 reduced the marks from 35 to 17. Shortly after, the UGC issued further amended terms and conditions.

14. On 19.08.2016, the promotion order was published, and the same has been challenged in these petitions.

15. On 28.11.2016, more than 200 Assistant Professors, including the petitioners, submitted representations to respondent No. 1 through the proper channel and the same were forwarded to the Secretariat for a decision. On 22.08.2017, the concerned Minister directed the authorities to determine the criteria. The OSD of the Secretariat forwarded the file to the Joint Secretary to finalize the criteria, but the Joint Secretary raised objections to the process adopted for the promotions.

16. On 21.09.2017, the Additional Chief Secretary recommended a review DPC. Furthermore, in response to a question raised in the State Legislative Assembly, the concerned Minister stated that documents pertaining to 24 candidates had been received.

17. On 13.01.2021, given the information through RTI that the criteria adopted for evaluation of the candidates who were promoted to the post

of Professor, were not a part of rules holding the field.

¶390

18. In the present case, the petitioners and other eligible assistant professors had submitted their details as per Schedule IV of the Rules, 1990 before the DPC. In Schedule-IV of the Rules, 1990, there is no criteria for the distribution of marks for publication of research papers, authoring books, innovation in teaching and design of new courses and curricula, etc. After submission of applications and relevant documents according to Schedule-IV of the Rules, 1990, on 03.06.2016, a new marking scheme was introduced contrary to the Rules, 1990 and UGC’s regulations and the respondent authorities on the basis of the Rules or criteria made by themselves, issued the order of promotion.

19. It was informed by the Information Officer under the Right To Information that the candidates were promoted contrary to the Rules, 1990 on 13.01.2021.

20. The concerned Minister also directed the respondent authorities on 22.08.2017 to determine the criteria for promotion. A direction was also issued on representations of some of the petitioners to convene a review DPC, but the respondent authorities failed to take any steps for assessment of eligibility of the petitioners for promotion to the post of Professor.

21. Further, it has been informed that when the question was raised in the State Legislative Assembly, it was answered/confirmed that 24 Assistant Professors had submitted their application forms along with the requisite documents before the DPC, but it was stated by the respondents that some of the petitioners failed to submit the relevant documents.

22. Taking into consideration the facts discussed above and the stand taken by the respondent authorities, which appears to be arbitrary, illegal and

contrary to the existing rules, which were prevalent in the year 20152016, therefore, the respondent authorities are directed to convene a review DPC and re-examine the eligibility of the petitioners on the basis of documents submitted by the petitioners along with their application forms.

23. Admittedly, the DPC proceedings were concluded on 01.07.2016, and the impugned promotion order was issued on 19.08.2016. Pursuant to a memo dated 03.10.2015 issued by the Additional Director, the details of assistant professors were invited according to Schedule-IV of the Rules, 1990, therefore, the petitioners/candidates who were eligible up to 03.10.2015 and who had submitted their application forms along with the relevant documents, shall be considered for promotion in accordance with the Rules, 1990. If the petitioners are found eligible for promotion to the post of Professor in their respective subjects, their seniority shall be recount from the date of issuance of promotion order dated 19.08.2016.

24. Let the entire exercise be completed within a period of 90 days from the date of receipt of a copy of this order.

25. The petitioners are at liberty to make a representation before the concerned authorities.

¶400

26. It is made clear that the Assistant Professors who have already been promoted to the post of Professor shall not be disturbed.

27. The records, if any, received, be sent back forthwith.

28. With the aforesaid observation(s) and direction(s), these petitions are hereby disposed of.
