Learned counsel appearing for the respective petitioners submitted that under the Rules, 1990, the Petitioners were entitled to promotion between 2006-2008, but no promotion was granted by the respondent authorities, therefore, they are seeking their promotion to the post of Professor in their respective subjects, as they have already submitted the requisite documents before the Departmental Promotion Committee (for short, "DPC") for consideration of their names for promotion to the post of Professor. However, the authorities have informed that the documents of some of the petitioners were not received, therefore, they were not found eligible. It is contended that a question was raised in the State Legislative Assembly, and it was answered/confirmed that 24 Assistant Professors had submitted their application forms along with the requisite documents before the DPC, but it was stated by the respondents that some of the petitioners failed to submit the relevant documents. They further submitted that the authorities/DPC have altered/changed the rules of promotion contrary to the regulations of the University Grants Commission (for short, “the UGC”); thus, a direction may be issued to the respondent authorities to reconsider the eligibility of the petitioners by holding review DPC, and if they are found eligible for promotion to the post of Professor in their respective subjects, they may be promoted in accordance with the law and prevailing rules from the date when other candidates/incumbents were promoted.
