Grievance raised by petitioners in this writ petition is that petitioners though stood retired as Government servants but Respondent- authorities not gave benefit of leave encashment.

Learned counsel for petitioners submits that identical issue came up for consideration before this Court in batch of writ petitions lead case being WP(S) No. 3870 of 2021 (Faguvaram Patel and others vs. State of Chhattisgarh) came to be allowed vide order dated

30.09.2022, wherein Court directed to grant leave encashment and surrender leave to petitioners within specified time and he prays for similar relief in this case also.

Learned State counsel for the petitioners submit that claim of petitioners will also be considered in light of order passed in Faguvaram Patel (supra), in accordance with law.

Considering the submission of learned counsel for petitioners as also the State counsel based on decision in WP(S) No. 3870 of 2021, this writ petition is disposed of directing the respondentsauthorities to consider the claim of petitioners for grant of leave encashment in the light of order passed in WP(S) No. 3870 of 2021 on 30.09.2022, within a period of three months from the date of production of copy of this order along with copy of writ petition and supporting documents.

With the aforesaid observation and direction, thiswrit petition finally stands disposed of.
