This MCC has been filed for restoration of WP(S) No 4041 of 2022 which was dismissed on 23-8-2023 as withdrawn.

In pursuance of the direction given by this court, the petitioner was directed to submit an application for grant of ex gratia payment before the respondent authority and the Bank has initiated steps for consideration, but the petitioner is insisting that in-spite of ex gratia amount he may be allowed to agitate the action of the bank in not considering his case for grant of compassionate appointment.

I have heard learned counsel for the parties.

The petitioner in original writ petition has claimed for grant of compassionate appointment and the said writ petition was dismissed as withdrawn and no liberty was sought by the petitioner for the reason

best known to him, therefore, he has filed this MCC with a prayer that the order dated 23-8-2023 passed by this court in WP(S) No 4041 of 2022 be modified and he may be granted liberty to file a fresh petition as his grievance is still not redressed.

Considering this aspect of the mater and also considering the fact that the petitioner’s grievance is still unredressed, the order dated 238-2023 passed by this court in WP(S) No 4041 of 2022, is modified to the extent that liberty is also granted to the petitioner to file a fresh petition if exigency still survives. Rest of the order dated 23-8-2023 passed by this court in WPS No 4041 of 2022 shall remain intact.

Accordingly, MCC No 87 of 2024 is disposed of.

A copy of this order be retained in the original file of WPS No 4041 of 2022.
